Farm help and the law

American Share Market is a listing service only. We are not an employer, staffing agency, employment agency or farm labor contractor, and we do not recruit, hire, pay, transport, house or supervise workers. Farms are solely responsible for hiring decisions, worker classification, wages, taxes, I-9, workers' compensation, safety and following all federal, state and local laws. We do not verify listings, users or background. Never pay money to get a job. Not legal advice.

These notes are not legal advice. A lawyer has not signed this page. Laws differ by state. Confirm them before you hire.

Employee or contractor

Work done under a farm's direction, such as chores or harvest, is usually employment. A 1099 post on this board is limited to a skilled trade where the person has their own tools and business. The farm classifies the worker and is responsible.

Ages

This board is 18 and older. Farm work has extra child-labor rules, including hazardous tasks for people under 16. A youth lane is not open.

Seasonal and migrant farm work

A farm that hires seasonal or migrant workers has its own duties, including disclosures and posters. This market is not a farm labor contractor and does not recruit, transport, house, or pay workers.

H-2A

American Share Market is not an H-2A agent. We do not file visas or charge recruitment fees. Use the Department of Labor and a licensed attorney or agent of your own.

Workers' comp and pay

The farm reports whether it carries workers' comp. The market does not check that answer. Every paid post needs a rate. A rate under $7.25 an hour gets a warning. Check your state minimum. The market does not take a cut of wages.

Background checks

The market does not run background checks. A farm that orders one has its own duties, including a stand-alone disclosure and adverse-action notices.

Meet safely

Tell someone where you are going. Read the farm's stand first. Do not send money to get a job. Do not cash a check for someone you have not met. Heat, chemicals, machinery, livestock, and heights should be named on the post. The farm provides the safety gear it promised.

OSHA, agricultural operations

I-9 and work authorization

The farm completes Form I-9. This market does not. We are not an agent for H-2A visas.
